I. GENERAL INFORMATION


§ 1

  1. These Regulations define the organisation and rules for using the services provided by Spółka Chochołowskie Termy spółka z ograniczoną odpowiedzialnością with its registered office in Chochołów in the Chochołów Thermal Baths facility, located at the address: Chochołów 400, 34-513 Chochołów.
  2. The Regulations use the following definitions, which should be understood each time:
    • Administrator or Company – Chochołowskie Termy spółka z ograniczoną odpowiedzialnością with its registered office in Chochołów (34-513) Chochołów 400, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for Kraków – Śródmieście in Kraków, 12th Commercial Division of the National Court Register under KRS number: 0000261672, REGON: 120300433, NIP: 7361640322;
    • Price list – a document available at https://www.chocholowskietermy.pl/cennik/ and at ticket offices, which specifies, among others, prices of admission tickets, including reduced tickets and special offers as well as prices of some services and additional fees (these are included in the additional information on fees/surcharges, which constitutes an appendix to the basic price list); The Company has the right to change or update the Price List, which will not constitute a change to these Regulations;
    • The Chochołów Thermal Baths, Complex, Facility or Thermal Baths – a facility under the name: the Chochołów Thermal Baths, located at the following address: Chochołów 400, 34-513 Chochołów, whose owner and administrator is Chochołowskie Termy spółka z ograniczoną odpowiedzialnością with its registered office in Chochołów, consisting of, among others, car parks, entrance halls, ticket offices, cloakrooms/changing rooms and showers, swimming pool area (including among others, indoor and outdoor pools, slide complex, water playground, healing area, area of peace and relaxation), SPA zone of (Chochołowskie SPA), sauna zone (Chochołowskie Saunarium ), normobaric (Chochołowska Normobaria) chambers, sports zone, including a gym (Chochołowskie Centrum Sportu), the complex of a restaurant and a service area;
    • Guest, Customer, Visitor or User – any person using specific types of services provided by the Company;
    • Organised group – a group consisting of at least 15 people, for which the Organiser is responsible for organising and booking a stay, as well as completing the required formalities and making payments;
    • Facility Management – persons managing the Facility on behalf of its administrator, i.e. Spółka Chochołowskie Termy spółka z ograniczoną odpowiedzialnością with its registered office in Chochołów;
    • Service or Staff – a team of people involved in the management and operation of the Facility, including in particular employees and associates (lifeguards, cashiers, Customer Service Office employees, SPA employees/therapists, sauna masters, catering staff, security staff, cleaning service employees, etc.), management, managers, etc
    • Guardian of an organised group – a natural person who supervises the safety and all activities of participants of a given organised group during their stay in the Thermal Baths, and in the case of an organised group of children and youth, is also responsible for their charges throughout their stay in the Thermal Baths;
    • Organiser – a natural person/entity that organises a stay in the Thermal Baths for an organised group;
    • Regulations/s – the content of this document and the content of other documents adopted by the Management Board of the Chochołów Thermal Baths and other authorised persons regulating the rules for using the services provided by the Company in the Facility.

§ 2

  1. The Regulations are the basis for using the services provided by the Company in the Chochołów Thermal Baths Facility and are the main document defining the rights and obligations of its Users.
  2. The Regulations define primarily:
    • the manner and form of providing services by the Company, ensuring the appropriate availability and quality of these services;
    • the conditions on the basis of which the Company provides services to its Users in the Facility, including the scope of activities of the Staff and the conditions of cooperation between the Staff and the Users of the Facility to ensure the efficiency of operation, safety and comfort of its Users;
    • rights and obligations of the Thermal Baths Users, liability rules.
  3. The rules for using the services provided by the Company in the Facility are additionally specified in the Appendices, the list of which is listed at the end of these Regulations and which constitute an integral part thereof.
  4. Each Customer is absolutely obliged to read the content of these Regulations before entering the Thermal Baths area and before starting to use individual devices/services provided by the Company, including before purchasing services online or ordering a given service, and then to comply with its provisions.
  5. Each Guest is also obliged to comply with: (i) bans, orders and recommendations presented on information or warning boards and signs placed on the premises of the Facility, (ii) instructions for the use of individual devices, as well as pictogram plates located next to them, (iii) regulations supplementary documents regarding the use of infrastructure and attractions (swimming pools, slides, saunas, SPA, etc.), which are available at individual attractions, and (iv) instructions and commands of the Staff, aimed at ensuring safety and order at the Facility.
  6. Terms and Conditions apply to all their Users. Upon entering the premises of the Facility or starting to use the Company’s services (whichever comes first), each User accepts the provisions of the Regulations and all other regulations related to ensuring security on the premises of the Facility. If the Guest does not agree to comply with the above documents, he/she should not use the services of the Company and enter the premises of the Facility.
  7. The Regulations are available for viewing on the official website of the Thermal Baths in the tab: https://www.chocholowskietermy.pl/regulamin/ and in the seat of the Company (at the ticket offices, at the Customer Service Office and at the SPA reception and at the reception of Chochołowska Normobaria)

II. RULES OF FUNCTIONING AND USE OF THE FACILITY


II.I. ZONES AND ATTRACTIONS
§ 3

  1. The main accessibility zones for Users are separated in the Thermal Baths. They are:
    • pool area;
    • SPA zone (Chochołowskie SPA);
    • saunas zone (Chochołowskie Saunarium);
    • normobaric chambers (Chochołowska Normobaria);
    • sports zone, including a gym (Chochołowskie Centrum Sportu);
    • a complex of restaurants and a service area.
      Each of the above zones has different functionality, and other fees may apply for entering these zones in accordance with the Facility Price List.
  2. Detailed rules for the use of each of the zones listed in sec. 1 above, as well as devices or attractions available in individual zones, including parameters and restrictions related to the possibility of their use, are specified in separate regulations (including workplace regulations), and they may also be specified in instructions, information boards and pictograms. The above documents are available at the entrances to each of the zones or attractions, and the regulations and instructions are also available on the official website of the Facility. Documents constituting an integral part of these Regulations are listed in the list of Appendices referred to in § 2 section 3 of the Regulations.
  3. Before using any attractions/devices, the Guest should carefully read and understand the rules of their use. In case of any doubts, please ask the Staff for clarification.
  4. The users of the Thermal Baths are obliged to strictly follow the instructions of the Staff and the recommendations on all warning boards located in the Facility. It is forbidden to destroy, soil or remove them from their previous places.
  5. It is forbidden to use individual zones and to use attractions/devices inconsistent with the rules of their use, in particular by persons whose conditions and physical condition prevent safe use, in accordance with the manufacturer’s (also instructions ). It is also forbidden to use the equipment or equipment of the Facility that is damaged, malfunctioning or out of use.
  6. Attractions and devices available in the Facility are controlled automatically.
  7. The Administrator exercises due diligence to ensure that as many attractions and devices located in the Facility as possible are available to Guests but does not guarantee and is not responsible for the constant and uninterrupted availability of all of them, some of which may be temporarily closed, e.g. due to weather conditions, maintenance or repairs carried out, safety conditions and other.
  8. Guests are not entitled to claim refunds or discounts if any of the facilities/attractions/amenities etc., are not available.
  9. The administrator does not guarantee immediate access to attractions and services located in the Facility. Due to the limited capacity of some attractions, guests must wait their turn to use them.

II.II. OPENING HOURS
§ 4

  1. The opening hours of the Complex (including individual zones, attractions, restaurants, etc.) are set by the Administrator, and information about them is available at the ticket offices, Customer Service Office and at: https://www.chocholowskietermy.pl/ .
  2. The management of the Facility reserves the right to change the opening hours and complete closure of the Facility or individual zones/attractions on specific days/hours, about which the Clients will be informed, including, in particular, the placement of information on the Facility’s website.
  3. Zones and attractions temporarily out of service are suitably marked and using them during this time is prohibited.
  4. The maximum allowable time for using individual services/attractions in the Facility by a given Customer depends on the type of admission ticket purchased. In the event of early departure from the Facility, i.e. not using the entire purchased time of stay, the refund for the unused time is not due.
  5. Attractions and devices (e.g. swimming pools, slides, playgrounds, saunas, restaurants, etc.) can be used by Guests only during their opening hours.
  6. Users will be admitted to individual zones of the Facility no later than 30 minutes before the designated and binding closing time
  7. Turning off individual attractions, as a rule, is preceded by a voice and acoustic message.
  8. Individual zones of the Complex, including in particular the swimming pool area, Customers are obliged to leave for at least 15 minutes before closing time and go to the cloakroom. The facility, together with the outside areas (including, in particular, the parking area), should be left no later than within 30 minutes after closing the main building of the Complex. Leaving the Facility after the appointed time will result in charging an additional fee in the amount in accordance with the applicable Price List.

II.III. USERS – ENTRY AND USE RESTRICTIONS; ORGANISED GROUPS
§ 5

  1. The Thermal Baths services cannot be used by persons:
    • suffering from infectious diseases (in accordance with the Act on preventing and combating infections and infectious diseases in humans);
    • suffering from infectious skin rashes, inflammatory lesions, etc.;
    • having open wounds (excluding minor cuts);
    • with individual medical contraindications;
    • whose behaviour indicates being intoxicated, under the influence of intoxicants or drugs or other substances with a similar effect, i.e. substances that interfere or limit the assessment of the situation or cause unnatural behaviour;
    • violating public order, generally accepted norms of behaviour, principles of morality or posing a risk and threat to oneself or others or to property;
    • behaving aggressively, dangerously and vulgarly;
    • violating the Regulations and/or not following the instructions of the Staff;
    • who previously violated the Regulations and/or who were previously banned from entering the Facility.

In doubtful cases, it is necessary to submit an appropriate certificate, on the basis of which the Facility Management may decide to allow a given person to enter the Complex

  1. It is strictly forbidden to bring and stay animals on the premises of the Facility. Due to the nature of the business and the need to ensure the highest sanitary standards, the ban also applies to dogs staying with the Guest as a guide for a blind/visually impaired person, assistance dogs, etc. – these animals may only enter the hall of the main building (including the lobby) and the main restaurant (Chochołowska Restaurant located on level O)
  2. The Management or persons authorised by them from the Staff are also entitled to refuse to provide services to the persons referred to in section 1 and section 2 above, including, in particular, the sale/realisation of an admission ticket) as well as to demand that these persons leave the Facility immediately, including without the possibility of demanding a refund of the admission ticket price.
  3. The Management or persons authorised by them from the Staff are also entitled to refuse to provide certain services by the Thermal Baths to Users who act contrary to the provisions of the Regulations. Failure to comply with the conditions contained in the Regulations may be interpreted as an attempt to disturb the peace in the area of the Baths, and thus may result in calling security by the employees of the Thermal Baths and, if necessary, the Police. Security staff, within the limits of applicable regulations, are entitled to take measures provided for in the Act of 22 August 1997 on the protection of people and property.
  4. Guests disturbing public order and generally accepted norms of behaviour, violating the provisions of the Regulations or failing to comply with the Staff’s instructions, may be asked to leave the Facility without refunding the price of the ticket paid due to the need to ensure the safety or comfort of the stay of other people staying in the Facility.
  5. Who in the cases referred to in sections 1 – 5 above, will not comply with the instructions of the Management of the Facility or persons authorised by them and will enter the area of the Thermal Baths or will not leave the Facility or will not comply with the instructions issued to him/her, and whoever violates the provisions of these Regulations or generally accepted social norms in any other way, will be subject to a penalty in the amount in accordance with the applicable Price List. The Company will also be entitled to claim supplementary damages exceeding the amount of the reserved contractual penalty on general terms.
  6. In the event of a dispute, for the purpose of resolving it, the Customer who does not agree with the assessment of the Staff and Facility Management regarding his/her condition has the right to request a sobriety test by an authorised body appointed to protect public order, including, in particular, the Police, summoned by the Staff Term at the express request of the Customer. It is also allowed for the assessment of the state of sobriety, including the examination of the level of alcohol in the exhaled air, to be made by authorised Term staff using a breathalyzer belonging to the Company – only at the explicit request of the Customer and with his/her explicit, voluntary consent. Failure to perform the above examinations will result in the Company’s right to consider a given person as not meeting the conditions for using the services of the Thermal Baths and to refuse entry to the Facility.
  7. People prone to muscle spasms, fainting, epilepsy attacks and cardiovascular diseases, as well as people who are dependent due to serious physical or mental disabilities or need supervision may stay in the Facility only in the presence and under the supervision of an appropriate adult guardian, who is obliged to report to the Staff the ailments of the person under his/her care.
  8. Children under the age of 13, completely incapacitated people, blind people, people who cannot move, undress and change their clothes without the help of others, may use the Facility only under the constant care and supervision of an adult guardian.
  9. Persons aged 13 to 16 may use the Facility, including individual zones, only under the constant and direct care of an adult staying together with the children (in the same zone, within the same attraction, etc.)
  10. The duty of care cannot be transferred to other persons, in particular to employees of the Thermal Baths. The carers are responsible for the people under their care, in particular for their safety, correct use of individual devices and attractions, and for any damage that may be caused.
  11. The guardian pays for the stay in a given zone according to the applicable Price List.
  12. Children up to 3 years of age and people using diapers are required to have and use throughout their stay in the pool area disposable diapers/ diaper pants designed specifically for bathing.
  13. Pregnant women and people with health problems can use the Thermal Baths offer only at their own risk, taking into account contraindications and medical recommendations concerning them.
  14. All attractions available in the Complex (including in particular slides, tubes and water massages) are used by each User at his/her own risk – before using a given attraction, the Guest should be aware of his/her own health and contraindications and is obliged to read, and strictly follow all instructions, warnings, access conditions and safety rules presented at the entrance to a given attraction. Children under the age of 16 must be under the constant supervision of an adult.
  15. The Company and Management are not responsible for any damage to swimwear and other items of clothing, jewellery, equipment, etc., while using the attractions, including, in particular, tubes and slides.
  16. If the age of a given User raises doubts, the Staff has the right to verify it by asking for a document with a photo confirming the date of birth.
  17. For safety reasons, the Staff is entitled to refuse to use a given attraction/service to persons who do not meet or comply with the terms and conditions of their use, as well as to persons who, for other reasons, in the reasonable opinion of the Staff, should not use a given attraction/service.
  18. Taking into account the other provisions of these Regulations, ultimately, each Guest, individually and on their own responsibility, makes an independent decision to use a given attraction/device/service available in the Facility, taking into account all possible threats and risks associated with it.

§ 6

  1. Before entering the Facility, organised groups are required to report to the Customer Service Office in order to agree on the detailed conditions of use, including the completion of appropriate forms by the guardians of the groups referred to below. Completion of the form by the group’s guardian is voluntary but necessary to use the services provided by the Company by a given organised group.
  2. Organised groups consisting of adults must have at least one adult guardian who is obliged to supervise the safety and all activities of the participants of this group.
  3. Organised groups of children and teenagers of school age must have at least one adult guardian for every starting 15 participants who will be responsible for the children throughout their stay in the Thermal Baths.
  4. Taking into account the above paragraphs, the Thermal Baths stipulates that the number of guardians and the way of organising care, organised groups are obliged to determine on their own, taking into account the age, the level of psychophysical development, health and possible disability of the persons entrusted to care, as well as the specificity of the Facility.
  5. Before an organised group of children and youth of school age starts using the attractions offered in the Complex, the group’s guardian undertakes to assemble the group’s participants so that they can watch the film in front of the entrance gates (in the hall, at the ticket offices located on level -1) instructions on the safety rules and operation of the Facility. For this purpose, the group’s guardian is obliged to report to the Ticket Office Manager.

§ 7


In the event of an emergency, the Management of the Facility may fully or partially limit the possibility of using the services of the thermal Baths (including admission to the Facility and the sale of admission tickets), in particular in the event of exceeding the limit of the permissible number of Users, in the event of an urgent need or in the event of other unforeseen circumstances, especially those threatening the health and safety of Users. Information on this subject will be provided each time in the form of appropriate messages.

II.IV. FEES AND TICKETS; DISCOUNTS
§ 8

  1. The right to enter the Complex – on the days and hours of its opening – is granted to persons who have a valid admission ticket (one-time ticket or pass), gift voucher, special gift voucher or other types of invitation issued by the Company (hereinafter jointly referred to as “Admission Ticket(s) “). Types of Entry Tickets and the group of persons entitled to use particular types of tickets (principles of sale of these tickets) are each time described in detail on the website: https://www.chocholowskietermy.pl . Relevant information can also be obtained from the Customer Service Office and ticket offices at the Company’s registered office.
  2. The prices of the Entry Tickets are specified in the Price List. The applicable Price List is available at the Company’s ticket offices and on the website: https://www.chocholowskietermy.pl/cennik/ .
  3. The Price List may be changed or updated by the Company from time to time, and the change or update of the Price List will not constitute a change to these Regulations.
  4. The Entry Ticket can be purchased directly at the Complex or via the website: https://www.chocholowskietermy.pl/sklep/ .
  5. Detailed rules for the sale of admission tickets purchased only on-site, at the Company’s registered office, are set out in the Regulations for the purchase and use of admission tickets to the Chochołów Thermal Baths Complex, available on the official website in the tab: https://www.chocholowskietermy.pl/regulamin-bilety/ , as well as at the ticket offices at the Company’s registered office. Detailed conditions for booking seats and purchasing tickets via the Company’s official website are specified in applicable Regulations for the sale and provision of electronic services, available on the official website in the tab enabling the purchase of a ticket.
  6. A single-entry ticket purchased on-site at the Company’s registered office is valid only on the day of purchase. The validity and deadline for the implementation of tickets purchased via the Internet, season tickets and all kinds of vouchers and invitations depends on their type and is determined at the time of purchase/issue.
  7. Depending on the type of Entry Ticket purchased/received by the Customer, the Customer has the right to access and use only such zones of the Complex and individual attractions/services covered by this ticket. Access and use of unpurchased zones, attractions and services require an additional fee in accordance with the price list for a given zone, attraction or service.
  8. After passing through the entrance gates, erroneously purchased Tickets are not refundable.
  9. A one-time admission ticket (including an all-day ticket, without a time limit) allows only one entry to the Facility – it is not possible to leave the Facility and return to it on the basis of such a ticket, even on the same day.

§ 9

  1. Reduced prices of Tickets to the Chochołów Thermal Baths are available to:
    • children from 3 to 16 years of age;
    • people with certification of disability and their carers (discount for 1 carer for 1 disabled person);
    • seniors over 60 years of age.
  2. Children under the age of 3 are admitted free of charge.
  3. The basis for purchasing an Entry Ticket at a reduced price is to present a valid document to the Staff for inspection, which will unequivocally confirm the right to a discount, including, in particular, the identity and age entitling to a given discount (identity card, ID card, certificate or other documents).
  4. It is possible to create a family ticket. The cashier decides how to create family tickets. The family ticket can be accompanied by:
    ● maximum 5 normal tickets;
    ● up to 10 reduced tickets.
    The condition is to purchase tickets on one receipt. Discounts are granted to a maximum of 14 people.
  5. The Company also reserves the right to present separate offers for Users, containing other promotions and discounts. The rules for using a given promotional campaign, discount, etc., are each time specified in the relevant regulations, rules and/or information available at the Customer Service Office.
  6. Reliefs, discounts, rebates and promotions, as a rule, do not combine and do not add up unless the regulations of a given promotion clearly state otherwise.
  7. Up-to-date information on the types, prices and rules for using the services and products offered by the Thermal Baths are included in the leaflets and guides available in the Facility, in the Price List, in the Customer Service Office, as well as on the website.
  8. All rebates and discounts are granted before the receipt for Entry Tickets is fiscalised.

§ 10

  1. After making the payment for the ticket at the ticket office or presenting the ticket that was purchased via the Internet, the Guest receives a transponder of the Electronic Customer Service System (data carrier) with an internal monetary limit in the amount depending on the selected offer, which is assigned to each transponder individually. Information on the current limit can be obtained at any ticket stand.
  2. The transponder is the basis for access to individual zones of the Facility. The Customer is obliged to pick up the transponder in person at the checkout. The lack of a transponder prevents entry. Users who illegally cross the entrance gates and illegally use paid services will be immediately expelled from the Facility and charged a fee for the lack of a transponder (in the amount corresponding to the limit assigned to the transponder).
  3. Jumping through the gates or changing zones without paying the Admission Ticket fee is prohibited.
  4. The transponder activates the Staff at the ticket office when handing it over to the Guest.
  5. The transponder should be put on the wrist in a way that prevents it from being lost or damaged, worn throughout the entire stay in the Facility, and if necessary, it should be shown at the request of the Thermal Bath Staff.
  6. The transponder enables the use of attractions and services subject to additional fees (within the purchased limit), and is also the key to opening and closing lockers in the cloakrooms. The limit referred to in the previous sentence may be used for the purchase of catering goods, SPA services and goods, payable attractions and other commercial products offered by the Company in the Facility.
  7. The Customer may apply for a change in the limit assigned to the transponder, i.e. for its complete removal, reduction or renewal, however, up to the amount specified in the applicable Price List (credit limit) and with the proviso that renewal of the limit is possible only after the current charge has been used and fully paid. Staff may, at their sole discretion, refuse to change the limit.
  8. The information terminals located in the Thermal Baths make it possible to check the remaining spending limit on a given transponder, the remaining time of the purchased ticket and the number of a properly closed cabinet assigned to a given transponder, with the proviso that the reading on the terminal may not include the current surcharge for exceeding the time limit and fees for using unpurchased zones.
  9. The time of using a given Entry Ticket is counted from the first reading of the transponder at the entrance gate to its return and passage through the exit gate. The use of gastronomy (applies to premises and points located behind the entrance gates), cloakrooms and showers is included in the stay. Any surcharges for exceeding the time limit are settled in accordance with the applicable Price List.
  10. One transponder allows only one passage through the entrance and exit gates for one person.
  11. It is forbidden to share the transponder with other Users – a given transponder can only be used by the User who activated it at the entrance gate.
  12. One User may only have one transponder activated by the Staff at the ticket office when handing it over to the Guest. Users with more than one transponder are obliged to return one of them, under pain of refusal of admission to the Facility. Failure to comply with the above condition, refusal to return one of the transporters and an attempt to invade the premises of the Facility may be considered as an attempt to disturb the peace in the area of the Thermal Baths, and thus cause the Staff to call the officers of the relevant services.
  13. The Organiser (if applicable) or the Group Guardian is responsible for the correct number of purchased Tickets and issued transponders for members of an organised group.
  14. In the event of a failure or incorrect operation of the transponder, the User is obliged to immediately report this fact to the Staff. In the event of damage or loss of the transponder, you should immediately go to the cash register staff (Shift Manager) to block the transponder. The fee for issuing a replacement transponder will correspond to the cost of purchasing the device, in accordance with the Price List.. If the fact of destruction/loss is not reported or reported too late, the owner of the transponder must cover the amount that will appear on the transponder – if it is found, and if the transponder is not found, the Guest will be obliged to pay the amount corresponding to the limit assigned to the transponder and the cost of purchasing the device, in accordance with the Price List.
  15. The user bears full responsibility for transactions made with the use of his/her transponder.
  16. The transponder is the property of the Company, and the Guest is obliged, before leaving the Facility, to return it to the Ticket Office Staff and pay for an extended stay and for services and goods registered on the transponder (in the case of making a transaction using the limit on the possessed transponder, the User is obliged to payment of the amount for which he/she used the limit assigned to the transponder).

  17. Not having a transponder at the exit is tantamount to its loss and payable (fee in the amount corresponding to the equivalent of the limit assigned to the transponder and the cost of purchasing the device, in accordance with the Price List).
  18. In a situation where the User leaves the Thermal Baths and, at the final settlement at the checkout, questions the payment for the service or goods, claiming that they did not buy or use them, an explanatory procedure will be implemented, and evidence will be collected (based on the operations and other data registered from the Company’s systems and records). The User who questions the purchase of goods or services has the right to submit a complaint (in accordance with the procedure described in § 2 of the Regulations), which does not release him/her from the obligation to pay for the goods or services.

II.V. CHANGING ROOMS AND LOCKERS; PREPARING FOR ENTRY
§ 11

  1. The use of the Facility’s cloakroom (changing room) and lockers is mandatory. The key to opening and closing the cabinets is a transponder.
  2. Due to the monitoring of changing rooms, you should change in cabins intended for this purpose. Only one guest may stay in the changing cabin, except when helping a child or a disabled or dependent person.
  3. Each of the Users, before leaving their belongings in the Thermal Baths, is obliged to familiarise themselves with the rules of using lockers, as well as to apply them.
  4. Each User is obliged to leave their luggage and personal belongings, not intended for use in specific zones, in a personal locker assigned to a given Customer, which should be effectively and properly locked. The rules for opening and closing lockers specify in detail and illustrate the relevant instructions available in visible places in the cloakroom area, which should be read before using and putting things in the locker.
  5. Each Guest has the right to use no more than one locker.
  6. The Customer is obliged to check that his/her locker is properly closed before going to the zones.
  7. Valuables should be placed in a deposit located in ticket offices or SPA reception. Due to size restrictions, only small items will be accepted. Other items should not be brought into the Facility.
  8. The Company shall not be liable for valuables left outside the deposit and other items left outside lockers, as well as for items left in open or incorrectly closed lockers.
  9. Prams or similar objects/devices cannot be placed in cabinets, and their use is prohibited in zones, starting from the entrance to the cloakroom. Therefore, the desire to store these items should be reported to the Staff, who will indicate the appropriate place where the item should be stored for the duration of using the Thermal Baths services.
  10. If you have other items that, due to their size, do not fit in the locker, you should report this fact to the Staff, who will, if possible, indicate the place where the item should be stored for the duration of using the Term services.

§ 12

  1. In the event of loss or destruction of the transponder enabling the opening of the locker, its contents will be transferred to the User only after the User has inspected and presented evidence that he/her is the owner of the left items. Opening such a locker in order to hand over items will take place by the Ticket Office Manager or another authorised member of the Staff in the presence of interested and authorised persons.
  2. The locker assigned to a different transponder than the one held by the person demanding its opening will be opened in the presence of the holder of the transponder to which the locker is assigned or in the presence of the Police, or if the above-mentioned would be impossible to carry out or would require taking disproportionate actions, the locker may be opened by an authorised member of the Staff together with a security officer who, depending on the circumstances of a particular case, may draw up an appropriate report of the actions taken, including photographic or film documentation – possible content of such a locker will be released to the User only after the inspection and presentation of evidence that he/she is the owner of certain items.

§ 13

  1. Towels can be rented for a fee at the ticket offices and in the SPA area (fee according to the Price List).
  2. The renter is responsible for the rented towel.
  3. The towel is the property of the Company, and the Guest is obliged, before leaving the Facility, to return it to the Staff at the checkouts.
  4. Not returning and not having the rented towel at the exit is tantamount to its loss and payable (fee according to the Price List).

§ 14


In each of the zones, there are different rules regarding hygiene and acceptable and required clothing and footwear, described in detail in the regulations listed in § 2 section 3 of the Regulations, the content of which every User using a given zone is obliged to read and strictly comply with.

II.VI. BASIC RULES OF USING THE FACILITY; CONTROL; CUSTOMER RESPONSIBILITIES AND OBLIGATIONS
§ 15

  1. Customers are obliged to use all services, devices and equipment (including vegetation) of the Facility with due care and respect and care for their condition. In the event of improper use, culpable contamination, damage, destruction or removal of certain items/devices from their current location, the User bears full legal and material responsibility for the resulting damage and losses.
  2. All equipment and devices located in the Facility are the property of the Thermal Baths – taking them outside the Facility is prohibited. In the event of destruction or damage to the equipment, the User shall bear the repair costs, which will be estimated each time by the Facility Management.
  3. Any finding by the Staff of improper handling of the Company’s property entrusted to the Customer (transponder, towels, bathrobes, restaurant equipment, deckchairs, etc.) will each time be treated as a serious violation of the Regulations. Notwithstanding the foregoing, the User will cover any material losses caused by his/her behaviour.

§ 16

  1. In the event of noticing any defects, faults, failures, but also accidents or any other situations that pose a real threat to other Users or the Service, the Customer is obliged to immediately notify the Staff.
  2. In the event of injury or bodily injury, regardless of their nature, the Guest (or his guardian) is obliged to immediately contact the lifeguard at the nearest station and follow his/her instructions.
  3. Thermal Baths are not responsible for increasing the damage resulting from the delay in reporting it.
  4. In the event of noticing any defects, faults, failures, but also accidents or any other situations that pose a real threat to other Users or the Service, the Customer is obliged to immediately notify the Staff.
  5. In the event of injury or bodily injury, regardless of their nature, the Guest (or his guardian) is obliged to immediately contact the lifeguard at the nearest station and follow his/her instructions.
  6. Thermal Baths are not responsible for increasing the damage resulting from the delay in reporting it.

§ 17

  1. The Guest is obliged to hand over to the Staff any items found on the premises of the Facility that are not his/her property.
  2. Lost items left by Users in the Facility, including in lockers, are stored in the Thermal Baths area for a period of 7 days from the date of finding them. After this date, the Company disposes of these items in accordance with the rules set out in the Act of 20 February 2015 on found items. The Company reserves the right to open bags left behind to verify that they do not contain hazardous materials and substances, as well as perishable foodstuffs.

§ 18

  1. Due to the nature of the Facility, Guests are required to take into account that there is a high risk of slipping and accidents on wet surfaces. For this reason, Guests should show increased attention, in particular in the area around the pools and at and on the slides. For the above reasons, Guests are required to move around the Facility only in appropriate footwear with anti-slip properties, except for zones where it is required to take off footwear.
  2. It is strictly forbidden to run and jump into the water throughout the complex.

§ 19

  1. It is forbidden to bring private strollers into the swimming pool area. Strollers must be left in the marked place. The thermal baths give you the opportunity to rent a stroller free of charge, which can be used in the swimming pool area. The number of baby strollers available for rent is limited
  2. It is forbidden to conduct on the premises of the Facility, without the written consent of the Management, any gainful activity, in particular commercial, marketing and service activities, including distribution of leaflets, sale of goods, offering and performance of services, including in particular private training, swimming lessons, lessons, etc.
  3. It is forbidden to enter rooms not intended for Customers, marked as available only for Staff, as well as to kitchens, utility rooms, offices, cloakrooms (except for the area with cabinets), warehouses, etc.
  4. It is forbidden to bring food, beverages and all kinds of alcohol and alcoholic beverages purchased outside a given zone into the area of the individual zones of the Facility (including, in particular, the swimming pool zone) and consume them. Items may not be brought in even if the Customer declares that he/she will not consume them during his stay in the Thermal Baths or leave them in cabinets. This prohibition does not apply only to food and beverages for Users covered by a specialised nutritional diet (in a disease or diet-related disease, confirmed by a relevant medical certificate, which must be submitted for inspection to the Staff) and baby foods. The ban applies to food, beverages and all kinds of alcohol and alcoholic beverages purchased before crossing the entrance gates, including at the Facility’s sales points (e.g. in the Chochołowska Restaurant, lobby bar, service outlets and shops located in the Facility in front of the entrance gates).
  5. It is forbidden to eat and drink (including alcohol) outside the designated areas.
  6. It is forbidden to move between food or drink areas.
  7. It is forbidden to take glass, porcelain and other items that may pose a threat outside the area of catering outlets.
  8. It is forbidden to smoke cigarettes, tobacco products, innovative tobacco products and electronic cigarettes, etc., in the Thermal Baths. Smoking is allowed only in specially designated places, properly marked and equipped.
  9. It is forbidden to bring into the Thermal Baths any dangerous items that may threaten the safety or health of other people, including, among others: firearms or other types of weapons, objects with a sharp tip, explosives, flammable materials, drugs or psychotropic substances.
  10. It is forbidden to bring into the area of individual zones: glass packaging as well as flammable items and liquids, e.g. pressure containers: including deodorants, hair sprays, etc. These items should be left in lockers.
  11. Recording videos and taking photos is allowed in all zones outside the sauna zone (where video or audio recording is strictly prohibited) and only for private purposes. Recording videos and taking photos should be done in a way that does not infringe the personal rights of other Users of the Facility.
  12. Professional video recording or taking photos may only take place after obtaining the prior consent of the Facility Management.
  13. It is also forbidden to fly drones and other similar aerial devices in the area belonging to the Company.
  14. It is forbidden to occupy places in the Facility when the Guest is not using them. This applies in particular to places in saunas, deckchairs, places in lounges, etc. (for example, a guest cannot reserve a deckchair by leaving a towel or an object on it). The guest is obliged to leave the place (i.e. remove their belongings) if he/she stops using it. The staff has the right to remove items left by people who do not actually use a given place.
  15. Any discriminatory behaviour against other Users of the Facility is prohibited.
  16. It is forbidden to behave in a way that may cause embarrassment to other Users, including any behaviour and actions that may be treated as an indecent act within the meaning of the criminal law.

§ 20

  1. In order to ensure the highest safety standards and to prevent violations of the provisions of these Regulations, including, in particular, prohibitions and restrictions on bringing certain items to the premises of the Facility (in particular food, beverages and all kinds of alcohol and alcoholic beverages purchased outside the Facility, dangerous items, etc.), the Company reserves the right to check the luggage of persons entering the Facility and the items brought in. Such control is carried out without infringing the personal rights of customers and with maximum respect for their personal dignity
  2. As part of the control referred to in sec. 1 above, the authorised Staff, in particular a security guard, may request the Guest entering the Facility to show the contents of bags and other luggage on their own, as well as, in justified and special cases – the contents of the pockets and/or to unfasten the outer clothing or pull up the sleeves of the sweatshirt, sweater or shirt etc. or trouser legs. Screening may also be carried out using appropriate equipment (baggage X-ray/scanner, other X-ray equipment, metal and explosive detection systems, etc.).
  3. The inspection is carried out only when the Customer voluntarily agrees to it. Consent may take any form, including implied, by voluntarily submitting to control. Refusal to give consent results in the fact that the Staff is entitled to refuse to provide services, including refusal to sell the Entry Ticket and to demand immediate leaving of the Facility.
  4. If, in the event of an inspection, it is found that the Customer has any item that is prohibited or potentially dangerous to bring, the Staff is entitled to refuse to provide services, including the refusal to sell the Entry Ticket and to demand immediate leaving of the Facility.
  5. In the event that the refusal to consent to the inspection is made by the Customer who already has a paid-for admission ticket, the ticket will be returned. Similar rules will apply when a Customer who already has a paid-for Entry Ticket is found to be in possession of prohibited items. In order to return the ticket in the above-mentioned situations, you should immediately, i.e. on the same day, contact the Thermal Baths Customer Service Office.
  6. The Company stipulates that it will not store and deposit dangerous items and things that are prohibited from being brought into the Facility.

§ 21

  1. Users use the Facility and its attractions, play equipment and sports equipment at their own risk.
  2. The Chochołów Thermal Baths is not liable for damages caused by force majeure, forces of nature, weather conditions and for damages resulting from the sole fault of the aggrieved party or a third party.
  3. The Thermal Baths is not responsible for events, damages and their consequences caused by Users’ failure to comply with the rules set out in these Regulations and other regulations, instructions and ordinances regulating the functioning of the Facility and specifying the rules of use.
  4. The Company is not responsible for interruptions in the supply of electricity, gas, water or other utilities, as well as for any related inconveniences that were not caused by the Thermal Baths.
  5. The Thermal Baths are not responsible for the loss, destruction or damage of items brought into the Facility and left in a place not intended for this.
  6. The User is liable for damages caused through his/her own fault or caused by culpable omission, including any damage caused as a result of improper use of the Facility and the use of devices located on its premises. In addition, each guest is responsible for damage caused to other guests by his/her fault.
  7. Parents/guardians bear full responsibility for their children and other persons under their care, including any damage caused by them

III. COMPLAINTS PROCEDURE
§ 22

  1. All complaints and grievances, as well as comments and requests, should be submitted in person to the Term Customer Service Office, in writing to the address of the Company’s registered office or by e-mail to the following address: , bok@chocholowskietermy.pl with the note: “Complaint”. The complaint form through which a complaint can be submitted is available at the Term Customer Service Office and on the Company’s website.
  2. Information about the consideration of the complaint will be provided to the complainant in writing or electronically (e-mail) to the contact details indicated by the complainant within the time limit in accordance with generally applicable regulations.
  3. The complaint should be reported immediately after noticing the defect in the services provided by the Company.

IV. PERSONAL DATA; MONITORING
§ 23

The administrator of personal data of persons using the services provided by the Thermal Baths is Chochołowskie Termy Spółka z ograniczoną odpowiedzialnością with its registered office in Chochołów (34-513) Chochołów 400, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for Kraków – Śródmieście in Kraków, 12th Division Commercial Register of the National Court Register under KRS number: 0000261672, REGON: 120300433, NIP: 7361640322.

§ 24

  1. The Thermal Baths facility is under video surveillance.
  2. Monitoring does not include cabins in changing rooms and toilets.
  3. The sole purpose of using video monitoring is to ensure the safety of people staying in the monitored area (including the safety of employees), order and protection of property, and also possible determination, investigation and defence of mutual claims.
  4. The registered information will not be used for purposes other than those listed above.
  5. It is noted that the monitoring will interfere with the privacy of customers as little as possible.

§ 25

V. FINAL PROVISIONS
§ 26

  1. In all matters not covered by these Regulations, generally applicable provisions of Polish law shall apply, including in particular the provisions of the Civil Code Act of 23 April 1964 and other relevant legal acts, as well as other internal regulations in force in the Thermal Baths.
  2. The Company reserves the right to change the provisions of these Regulations. Changes to the Regulations will be valid on the date specified along with the information about its change (subject to section 3 below). The version of the Regulations that are in force at the time of using the Company’s services at a given moment should be considered binding for a given Customer (changes will apply to contracts concluded after the entry into force of the amended version of the Regulations).
  3. The attachments are an integral part of the Regulations. Updating the list of attachments, changing their titles, numbering, adding/deleting attachments and similar actions apply automatically and do not require the procedure described in section 2 above.
  4. The Regulations come into force on 27.06.2023.
